RETURN & REFUND POLICY

At Grunff Stwart, we want you to be satisfied with your purchase. This Return & Refund Policy explains how returns, exchanges, refunds and remedies are handled for purchases made through GrunffStwart.store.

Nothing in this policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL).

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Under the ACL, goods supplied to consumers must, among other things:

  • be of acceptable quality;

  • be fit for any disclosed purpose;

  • match their description;

  • match any sample or demonstration model where applicable;

  • come with good title and undisturbed possession; and

  • comply with any applicable express warranties.

If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and whether the failure is major or minor.

Your rights under the Australian Consumer Law apply independently of, and in addition to, our voluntary returns policy below.

2. 30-Day Change-of-Mind Returns

In addition to your rights under the Australian Consumer Law, Grunff Stwart voluntarily accepts eligible change-of-mind returns requested within 30 days of delivery.

To qualify for a change-of-mind return, the item must:

  • be unused, unworn and unwashed;

  • be in its original condition;

  • have all original tags attached;

  • be returned with its original packaging where reasonably possible; and

  • show no signs of wear, washing, alteration, damage, misuse, odour or contamination.

You must provide proof of purchase, such as your order confirmation, order number or other reasonable evidence of purchase.

This voluntary 30-day policy does not limit your rights where a product fails to comply with the Australian Consumer Law.

3. Change-of-Mind Exclusions

Unless required by law, we may refuse a change-of-mind return where:

  • more than 30 days have passed since delivery;

  • the item has been worn, washed, used or altered;

  • original tags have been removed;

  • the item has been damaged after delivery;

  • the item is not returned in substantially its original condition;

  • the item was clearly marked as final sale and the return is solely due to change of mind;

  • the item is personalised or made to order; or

  • the product is a hygiene-sensitive item that cannot reasonably be resold once opened or used.

These exclusions apply only to our voluntary change-of-mind policy. They do not remove any remedy available to you under the Australian Consumer Law for faulty or non-compliant goods.

4. Faulty, Damaged or Incorrect Items

If you receive an item that is faulty, damaged, unsafe, materially different from its description or otherwise fails to comply with a consumer guarantee, please contact us as soon as reasonably possible at:

Please provide:

  • your full name;

  • your order number;

  • a description of the issue; and

  • photographs or other information reasonably necessary for us to assess the issue, where appropriate.

We may reasonably inspect or assess the product before determining the appropriate remedy.

Nothing in this section limits your rights under the Australian Consumer Law.

5. Major Problems

A product may have a major problem where, for example:

  • a reasonable consumer would not have purchased it had they known about the problem;

  • it is unsafe;

  • it is significantly different from its description, sample or demonstration model;

  • it is substantially unfit for its normal purpose and cannot easily be fixed within a reasonable time; or

  • it is substantially unfit for a purpose you told us about before purchasing and cannot easily be fixed within a reasonable time.

Where there is a major failure under the Australian Consumer Law, you may be entitled to reject the goods and choose between:

  • a refund; or

  • a replacement of the same type and similar value, where reasonably available.

You may alternatively choose to keep the product and seek compensation for any reduction in its value where permitted under the Australian Consumer Law.

6. Minor Problems

Where a problem is not major, we may be entitled to provide an appropriate remedy, such as a repair, within a reasonable time.

If we cannot or do not remedy the problem within a reasonable time, you may have additional rights under the Australian Consumer Law, which may include having the problem remedied elsewhere and recovering reasonable costs, or rejecting the goods and obtaining a refund or replacement where permitted by law.

7. Sale and Promotional Items

Sale, discounted and promotional products remain protected by the Australian Consumer Law.

We will not refuse a remedy required by law merely because an item was purchased on sale or at a discounted price.

However, items clearly identified as Final Sale may be excluded from our voluntary change-of-mind returns policy.

If a product was discounted because of a specific defect that was clearly disclosed to you before purchase, you generally cannot claim a remedy solely because of that disclosed defect. Other consumer guarantee rights may still apply.

8. Incorrect Size or Change of Preference

Choosing the wrong size, colour or style, or simply deciding that you no longer want an item, is generally treated as a change of mind rather than a product fault.

Eligible items may nevertheless be returned under our voluntary 30-day change-of-mind policy.

We recommend checking all available sizing information before placing your order.

Please include your order number and the reason for your return.

Do not send a return until you have received the applicable return instructions and return address from our customer service team.

Where appropriate, we will provide instructions explaining how and where to return the item.

10. Return Shipping Costs

Change-of-Mind Returns

For voluntary change-of-mind returns, the customer is responsible for return shipping costs unless we expressly agree otherwise.

Original shipping charges are generally non-refundable for a change-of-mind return, except where required by law.

Faulty or Non-Compliant Products

Where a product fails to comply with the Australian Consumer Law, return or collection costs will be handled in accordance with your rights under the ACL.

Where goods cannot reasonably be returned without significant cost because of the nature of the failure or the nature of the goods, we will comply with any obligation under the Australian Consumer Law to collect the goods at our expense.

11. Refunds

Once a return has been received and assessed, we will notify you of the outcome.

For approved voluntary change-of-mind returns, the applicable refund will be processed after the returned item has been received and inspected.

For refunds required under the Australian Consumer Law, we will provide the refund in accordance with our legal obligations.

Where applicable, refunds will ordinarily be issued using the original payment method unless you agree to another method.

Processing times after a refund has been issued may vary depending on your bank, card issuer or payment provider.

12. Exchanges

Where available, we may offer exchanges for eligible change-of-mind returns.

For products that fail to comply with the Australian Consumer Law, your entitlement to a replacement, refund, repair or other remedy will depend on the circumstances and your statutory rights.

Availability of a replacement may depend on stock.

13. Proof of Purchase

We may request reasonable proof that the product was purchased from Grunff Stwart.

Acceptable evidence may include:

  • an order confirmation;

  • an invoice;

  • a receipt;

  • your order number;

  • a payment record; or

  • other reasonable evidence showing that the product was purchased from us.

14. Gifts

Where an item was purchased as a gift, we may request proof of the original purchase before processing a return or statutory remedy.

Any refund will generally be handled consistently with the original transaction and applicable law.

15. Products Damaged by the Customer

Consumer guarantees do not generally entitle a customer to a remedy where the problem was caused by misuse, abnormal use, accidental damage or other conduct by the customer after delivery.

However, this does not affect rights relating to any separate defect or failure for which Grunff Stwart remains responsible under applicable law.

16. Products with Disclosed Defects

If a particular defect or problem was specifically brought to your attention before you purchased the product, you may not be entitled to a remedy for that particular disclosed issue.

Your rights regarding any other undisclosed problem remain unaffected.

17. Warranties and Consumer Guarantees

Any warranty offered by Grunff Stwart, a manufacturer or another party operates in addition to your rights under the Australian Consumer Law.

The expiry of a voluntary or manufacturer's warranty does not automatically mean that your statutory consumer guarantee rights have expired.

Consumer guarantees may continue to apply for a reasonable period having regard to matters such as the nature, price and expected durability of the product.

18. Compensation for Loss or Damage

In some circumstances, where a failure to comply with a consumer guarantee causes reasonably foreseeable loss or damage, you may also be entitled to compensation under the Australian Consumer Law.

Nothing in this policy excludes liability that cannot legally be excluded.

19. No Unlawful “No Refund” Restrictions

Nothing in this policy should be interpreted as stating that Grunff Stwart does not provide refunds under any circumstances.

Where the Australian Consumer Law gives you a right to a refund, replacement, repair, compensation or another remedy, our internal policies, promotional conditions, warranty periods or return periods do not override those statutory rights.

20. Online Purchases

This policy applies to eligible products purchased directly through GrunffStwart.store.

Australian consumer protections applicable to online purchases apply in addition to the terms of this policy.

21. International and Overseas Fulfilment

Some products may be dispatched or fulfilled from locations outside Australia.

Where Grunff Stwart directly supplies goods to consumers in Australia, nothing about overseas dispatch or fulfilment is intended to exclude any rights that apply under the Australian Consumer Law.
